xBite Terms of Use

Effective Date: May 1, 2026

PLEASE NOTE: Section 13 requires certain disputes to be decided through binding arbitration on an individual basis. Arbitration takes place outside court, without a judge or jury, and an award is generally subject to more limited review than a court decision.
Review these Terms before registering, opening, or using any xBite app, website, web interface, video streaming feature, chat, account tool, or related service. If you do not accept every part of these Terms, you may not access or use the Service.

1. Agreement and Service Scope

1.1. These Terms of Use (the "Terms") are a binding contract between you and xBite ("xBite", "we", "us", or "our") and apply whenever you access or use xBite.
1.2. The "Service" includes our iOS applications, websites, web interfaces, communication tools, video streaming and chat functions, account capabilities, and all related software, systems, content, and support we provide.
1.3. xBite is a non-commercial video streaming and chat service through which eligible people may register, stream through iOS or the web, and interact using chat and related community functions.
1.4. You agree to these Terms by registering, signing in, entering the Service, using any feature, or continuing to use xBite after the Terms are shown to you.
1.5. We may revise the Terms periodically. If the law requires notice of a material revision, we will provide it. Use of the Service after revised Terms take effect constitutes acceptance of the revised version.
1.6. Individual features may also be governed by community standards, product notices, technical instructions, app-store conditions, operating-system requirements, or other supplemental rules. Those rules form part of these Terms when they apply to your use.

2. Who May Use xBite

2.1. You may use the Service only if you are at least eighteen (18), or have reached the higher legal age of majority that applies in your jurisdiction.
2.2. By accessing xBite, you confirm that you have legal capacity and authority to enter into and follow these Terms.
2.3. The Service must not be accessed or used where that activity would breach law, sanctions, export controls, a court order, or another binding legal restriction.
2.4. Access may be limited, suspended, or discontinued for a person or territory when we reasonably determine that continued availability would create a legal, safety, security, compliance, or operational risk.
2.5. xBite is provided for lawful, personal, non-commercial activity. Business promotion, advertising, solicitation, or other commercial use requires our express prior written approval.

3. Accounts and Account Security

3.1. An account may be required for some Service functions. Registration or verification may require the information presented in the applicable sign-up flow.
3.2. Information supplied to xBite must be truthful, current, complete, and not misleading, and you must keep it accurate for as long as you use the Service.
3.3. Unless we specifically permit otherwise, a person may hold only one account, and accounts may be created and operated only by natural persons.
3.4. You are responsible for safeguarding your sign-in credentials and for activity conducted through your account, including activity you did not authorize.
3.5. Tell us promptly if credentials are missing, stolen, compromised, or if you suspect unauthorized access.
3.6. We may request verification, review account activity, reject a registration, limit functions, suspend access, or close an account when we reasonably believe information is false, the account is being misused, or these Terms have been violated.

4. Permission to Access the Service

4.1. While you comply with these Terms, xBite gives you a limited, revocable, personal, non-exclusive, and non-transferable right to access and use the Service for its intended purpose.
4.2. Except where applicable law does not allow the restriction, you may not copy, alter, distribute, sell, lease, sublicense, reverse engineer, decompile, derive source code from, or create derivative works from the Service.
4.3. You must not disrupt, overload, damage, interfere with, or seek unauthorized entry to any Service component, account, server, network, or supporting system.
4.4. Bots, crawlers, scrapers, scripts, automation, or comparable tools may not access, collect from, or interact with xBite unless we have authorized that use in writing.
4.5. You are responsible for compatible hardware, software, connectivity, device permissions, and operating conditions necessary to use the Service.

5. Rules for Responsible Use

5.1. Use xBite lawfully, responsibly, and with respect for other people.
5.2. You may not create, upload, stream, send, show, promote, request, encourage, or distribute content or conduct that is illegal, infringing, fraudulent, deceptive, abusive, exploitative, threatening, hateful, discriminatory, privacy-invasive, or otherwise harmful.
5.3. Do not impersonate a person or organization, misstate who you are, create a deceptive profile, use another person’s image without permission, or claim a false relationship with xBite or anyone else.
5.4. Harassment, bullying, intimidation, blackmail, humiliation, threats, stalking, and targeted abuse are prohibited.
5.5. You may not distribute malware or malicious code, conduct phishing or fraud, send spam or unauthorized advertising, or use misleading external links to redirect or exploit users.
5.6. Do not gather, disclose, sell, exchange, or misuse another user’s personal information, including private contact details, identity records, credentials, location, or private messages.
5.7. xBite must not be used to organize, enable, encourage, or take part in crime, abuse, violence, exploitation, terrorism, unlawful drug activity, or conduct that creates a serious risk of harm.
5.8. You may not defeat, disable, manipulate, or evade moderation, safety functions, technical controls, account restrictions, age or geographic limits, or enforcement decisions.

6. Community Protection Standards

6.1. Because xBite enables video streaming and communication, additional safety requirements may apply to profiles, streams, messages, media, and other activity in order to protect users and Service integrity.
6.2. Public profiles and content must not contain unauthorized images, deceptive identity details, private contact information, outside advertising, spam, or prompts that push users toward unsafe or unauthorized communication channels.
6.3. Nudity, explicit sexual material, sexual solicitation, sexualized behavior, grooming, child sexual abuse material, exploitation of minors, and any sexualized content involving a minor are strictly forbidden. xBite applies zero tolerance and may report suspected violations to the appropriate authorities.
6.4. Hate speech, discriminatory attacks, threats, coercion, privacy abuse, humiliation, and attempts to exploit another person are not allowed.
6.5. Content or behavior involving credible violent threats, severe harm, animal cruelty, terrorism, misuse of weapons, unlawful substances, or encouragement of self-harm is prohibited.
6.6. When appropriate or legally required, we may remove material, limit functions, suspend or terminate accounts, retain relevant evidence, coordinate with safety organizations, and report conduct to competent authorities.
6.7. We have no obligation to monitor every message, stream, interaction, or item. We may nevertheless inspect, moderate, restrict, or remove content and activity at our discretion where permitted by law.

7. Content You Provide

7.1. "User Content" includes any stream, recording, message, profile text, image, username, comment, reaction, information, or other material you create, submit, upload, show, transmit, or otherwise provide through the Service.
7.2. Ownership of rights you already hold in User Content remains with you; these Terms do not assign that ownership to xBite.
7.3. You confirm that you own the User Content or hold every permission needed both to provide it through xBite and to grant the licenses set out here.
7.4. When User Content is made available through the Service, you grant xBite a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, transmit, display, perform, publish, moderate, remove, technically adapt, and otherwise use that content as needed to operate, secure, maintain, improve, and deliver the Service.
7.5. You grant other users a limited, revocable, personal, and non-transferable right to view and interact with your User Content only through Service features and as allowed by these Terms.
7.6. You remain solely responsible for User Content and the consequences of sharing it. xBite does not endorse User Content or guarantee its accuracy, legality, quality, or dependability.
7.7. We may remove, block, limit, or disable User Content when we believe it breaches these Terms, violates rights, creates risk, or is unsuitable for the Service.
7.8. Do not place confidential information in public or interactive areas. Depending on feature settings, other users may see User Content shared in profiles, chats, and streams.

8. xBite Intellectual Property

8.1. xBite or its licensors own the Service and its software, source and object code, visual design, interfaces, graphics, trademarks, service marks, logos, features, documentation, and related materials. Intellectual-property and other laws protect those assets.
8.2. No Service right is granted to you except the limited permission expressly stated in these Terms.
8.3. You may not conceal, delete, or modify proprietary, attribution, branding, or legal notices appearing in the Service.
8.4. If you send ideas, feedback, proposals, or bug reports, xBite may use them without restriction or compensation, except where law provides otherwise.

9. External Platforms and Providers

9.1. xBite may depend on or connect with app stores, operating systems, browsers, cloud infrastructure, communications services, analytics, moderation tools, and other third-party products.
9.2. Separate terms, policies, technical rules, and privacy practices may govern those products. You are responsible for following third-party requirements that apply to you.
9.3. We do not control external services and are not responsible for their availability, conduct, omissions, content, security, rules, or performance.
9.4. If an external provider changes, becomes unavailable, introduces risk, or is no longer compatible, we may change, pause, or remove any dependent xBite feature.

10. Interactions with Other Users

10.1. You are responsible for your communications and other dealings with users through streams, chats, comments, messages, and every interactive function.
10.2. xBite does not verify or promise the identity, intent, statements, history, behavior, or reliability of any person using the Service.
10.3. Use appropriate judgment before sharing information, continuing a conversation, or moving an interaction outside xBite.
10.4. Except where applicable law does not allow an exclusion, we are not responsible for user disputes, deception, misconduct, disagreement, or resulting harm.

11. Restriction, Suspension, and Closure

11.1. You may discontinue use whenever you choose.
11.2. With or without prior notice, we may restrict, suspend, or terminate Service access when we reasonably believe you breached the Terms, endangered others, misused xBite, infringed rights, failed to cooperate with verification or safety measures, or created legal, operational, safety, or reputational risk for xBite or another person.
11.3. We may also disable or remove User Content, preserve appropriate records, limit features, or take another proportionate enforcement measure when we consider it justified or legally required.
11.4. If access is suspended or terminated, you must stop using the Service and may not return through a different or newly created account unless we give express permission.
11.5. Provisions intended by their nature to continue will survive, including User Content licenses, intellectual property, disclaimers, liability limits, indemnification, disputes, governing law, and general provisions.

12. Statements You Make to Us

12.1. You confirm and warrant that you satisfy every eligibility rule in these Terms.
12.2. You confirm and warrant that you have the lawful right and capacity to enter this agreement.
12.3. You confirm and warrant that information you submit to xBite is accurate, complete, up to date, and not deceptive.
12.4. You confirm and warrant that your Service use, User Content, and interactions will follow these Terms, applicable laws, third-party platform requirements, and the rights of others.
12.5. You confirm and warrant that no law prohibits you from using online communication services and that you are not legally required to register as a sex offender.

13. Disputes and Binding Arbitration

13.1. Informal process. Before either party begins a formal claim, you and xBite will first attempt in good faith to resolve any dispute connected with the Service or these Terms. Start by emailing [email protected] with a reasonably detailed description.
13.2. Binding arbitration. If no resolution is reached within sixty (60) days after the initial written notice, the matter will be finally determined by binding arbitration administered by the London Court of International Arbitration ("LCIA") under the LCIA Rules then in force, as modified by these Terms.
13.3. Unless both parties agree differently, London, England will be the seat, English will be the arbitration language, and a single arbitrator will decide the matter.
13.4. Individual basis. To the fullest extent permitted, claims may proceed only individually. Class, collective, consolidated, representative, and private-attorney-general proceedings are excluded.
13.5. Limited court remedies. Either party may ask a competent court for temporary or preliminary injunctive relief involving intellectual property, security, Service misuse, or unauthorized access.
13.6. Mandatory protections. This Section does not waive consumer protections or dispute-resolution rights that cannot legally be waived.

14. Service Disclaimers

14.1. xBite is supplied on an "as is" and "as available" basis.
14.2. As far as the law allows, we disclaim every express, implied, statutory, and other warranty or condition, including merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement.
14.3. We do not promise uninterrupted, error-free, secure, or continuous availability, compatibility with every system or device, availability in every place or at every time, or freedom from harmful components.
14.4. We make no warranty that User Content will be accurate, dependable, retained, available, or fit for a specific use.
14.5. You are responsible for how you use xBite and for protecting your information, devices, credentials, and accounts.

15. Limits on Liability

15.1. To the maximum extent law permits, xBite and its affiliates, directors, officers, employees, contractors, licensors, and providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for lost data, goodwill, reputation, opportunity, or business interruption arising from the Service or these Terms.
15.2. To the maximum lawful extent, xBite is not responsible for User Content, user conduct, external platforms or services, unauthorized access, technical or internet failures, device problems, or circumstances outside reasonable control.
15.3. For all claims connected with the Service or these Terms, xBite’s aggregate liability is restricted to the greatest extent applicable law allows.
15.4. These Terms do not exclude or restrict liability that the law makes non-excludable, including fraud, intentional wrongdoing, or death or personal injury caused by negligence where such a limitation is prohibited.

16. Your Indemnification Obligations

16.1. To the fullest lawful extent, you will defend, indemnify, and hold harmless xBite, its affiliates, officers, directors, employees, contractors, licensors, and providers against claims, demands, losses, damages, liabilities, costs, and expenses connected with: (a) your use of xBite; (b) your User Content; (c) a breach of these Terms; (d) a violation of law or another person’s rights; or (e) your dealings with other users.
16.2. We may take exclusive control of a defense covered by this indemnity, and you agree to provide reasonable cooperation.

17. Privacy

17.1. Our Privacy Notice and any related notice available through xBite explain how information associated with the Service is collected and used.
17.2. By using xBite, you understand that information may be processed as required to operate, protect, moderate, support, and improve the Service, subject to applicable privacy law and our Privacy Notice.

18. Additional Legal Provisions

18.1. Assignment. You may not assign these Terms, your account, or any associated right or duty without our prior written approval. We may assign the Terms through a merger, acquisition, reorganization, change of control, transfer of assets, operation of law, or as otherwise legally allowed.
18.2. Severability. If a term is held invalid, illegal, or unenforceable, it will apply to the maximum permissible extent and the rest will remain effective.
18.3. No waiver. A failure or delay in enforcing any provision does not waive that provision or any right to enforce it later.
18.4. Events beyond control. We are not liable for delay or failure caused by circumstances outside reasonable control, including internet or hosting outages, labor disputes, natural disasters, emergencies, government measures, war, civil disorder, cyberattacks, and interruptions involving third-party services.
18.5. Entire agreement. These Terms and incorporated policies or notices are the complete agreement between you and xBite about the Service and supersede earlier agreements or understandings on that subject.
18.6. Governing law. Subject to Section 13, the laws of England and Wales govern and interpret these Terms, without applying conflict-of-laws principles.
18.7. Non-waivable consumer rights. Nothing here limits statutory consumer protections that cannot be waived. Residents of the European Union and other jurisdictions with mandatory consumer law may have additional local rights.
18.8. Notices. We may deliver notices in the Service, by email, on our website, or through any other legally accepted method. Unless we identify another address, notices to xBite should be emailed to [email protected].
